Collection and Use
Product Inquiries and Orders
Ooka may collect the following type of personal information relating to any user of this Site who orders or inquires about products by means of this Site:
- contact information including name, address, telephone number and e-mail address;
- contact information for a parent or guardian if the user is under 18 years of age;
- information regarding personal preferences with respect to the types of products that are for sale on this Site;
- if applicable, billing, credit card, banking and other financial information required to process any purchases; and
- other personal information which a reasonable person would consider ancillary to the types of information set out above.
The above noted information is used by Ooka for the following purposes and for all other purposes reasonably ancillary thereto:
- to respond to an inquiry;
- to process payment for an order;
- to fulfil an order;
- if applicable, to respond to any inquiries about an order ; and
- to keep interested users up-to-date on the activities of Ooka (including advising them of new products, programs and services).
Please note, Ooka uses a third party for payment processing. Consequently, credit card and certain other items of financial information provided when making a purchase from this Site are being collected by the payment processor and not Ooka. The payment processor has agreed to protect the confidentiality and security of the information that it collects from users of this Site and to use that information solely to provide payment processing services to Ooka.
Access to this Site
When a user accesses this Site, Ooka’s server may attach a small text file to the user’s hard drive — a cookie. The cookie is used to identify the user whenever he or she returns to this Site. The information contained in the cookie is also used to tailor how this Site is presented to the user. Please note, by changing the settings of their web browsers, users can prevent cookies from being set, but this may prevent them from participating in certain activities available on this Site.
Ooka collects IP addresses from users of this Site and examines information about the browser used as made available by the browser’s user-agent. From these sources, Ooka may ascertain and collect the following type of information:
- the person who controls the IP address from which the user is accessing this Site;
- an approximation of the physical location of any servers associated with the IP address;
- the browser being used by the user to access this Site; and
- the operating system used by the computer from which the user is accessing the Internet.
Ooka may passively collect information relating to how users of this Site interact with this Site. For example, what search terms did they use to locate this Site and how much time did they spend on each page of this Site.
By using this Site, you consent to the collection of the above-noted information by Ooka and its use in aggregated form by Ooka for the following purposes and for all other purposes reasonably ancillary thereto:
- to understand how this Site is being used;
- to tailor how this Site is presented to the user; and
- to develop new products, programs and services.
Interactive Web Site Activities
Ooka may collect the following type of personal information relating to any user of this Site who chooses to participate in other activities offered on this Site (for example, contests or surveys):
- contact information such as name, address, telephone number and e-mail address;
- contact information for a parent or guardian if the user is under 18 years of age; and
- other personal information which a reasonable person would consider ancillary to the types of information set out.
This information is used by Ooka for the purpose of administering the web-based activity, for other purposes reasonably ancillary to that purpose and for any purpose disclosed at the time when the user signed up to participate in the web-based activity.
This Site may include other requests for its users to volunteer their personal information. When Ooka creates an opportunity for users to volunteer their information through this Site, Ooka will disclose the purposes for which the personal information is being collected and seek an express consent to use the personal information collected for such purposes.
As well, this Site provides users with several opportunities to “opt in” to receive information or announcements from Ooka. If a user opts to receive information or announcements from Ooka, the personal information that he or she provides may be used by Ooka to: (i) provide the information and announcements; and (ii) tailor the type of information and announcements provided by Ooka to the user. Additionally, a user of this Site who has previously opted to receive information and announcements may subsequently “opt out” by following the directions for doing so on this Site.
Retention and Destruction
Ooka keeps personal information only for as long as the personal information is required for the purposes for which it was collected. Consequently, there is no single retention period applicable to all instances of personal information collected by Ooka.
When any personal information is no longer required by Ooka for the purposes for which it was collected, Ooka destroys the personal information in a manner which takes into account the sensitivity of that information.
Ooka uses physical, organizational and technological safeguards to protect personal information in its possession. For example, Ooka uses encryption to safeguard information about a purchase being transmitted over the Internet. HOWEVER, PLEASE NOTE THAT NO DATA TRANSMISSION OVER THE INTERNET CAN BE GUARANTEED TO BE COMPLETELY SECURE. CONSEQUENTLY, OOKA EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS (WHETHER EXPRESS OR IMPLIED) THAT ANY INFORMATION TRANSMITTED TO OR BY OOKA OVER THE INTERNET IN RELATION TO A PURCHASE WILL BE COMPLETELY SECURE.
Ooka may share personal information which it has collected with its employees, agents and other representatives who need to use that information in connection with one or more of the purposes for which that personal information was collected.
From time to time, Ooka may engage service providers to provide certain limited services such as shipping products, hosting this Site or processing financial transactions. Ooka will only provide those service providers with the personal information they need to deliver the service for which they were retained. Ooka will also require those companies, through contractual means, to safeguard such information, maintain its confidentiality and not to use that information for any purpose other than providing the services for which they were retained. Please note that such services providers may be located outside of Canada.
Ooka may access and disclose any personal information which it has collected if required or permitted to do so by law (for example, in order to comply with a legal requirement, including, but not limited to, one imposed by a warrant, subpoena, court order or like instrument served on Ooka or in an emergency to protect the life, health or security of any person).
Please note that Ooka may disclose the personal information of the users of this Site to any successor or any assignee of Ooka’s assets relating to this Site.
